<p><span style="font-size: 14px;">欧盟商标注册后10年有效，有效期自<strong>申请日</strong>起算；到期日前6个月内可以办理续展，宽展期6个月；续展有效期10年。商标注册后的无效/撤销申请，一般可根据欧盟《商标条例》下述条款提出：&nbsp;</span></p><p><br/></p><p><span style="font-size: 14px;">1.依据《商标条例》第52条至第54条提无效：（1）违反禁注条款；（2）申请人在提交商标申请时有恶意；（3）在先商标人或名称权、肖像权、版权、工业产权等在先权利人提出无效请求；</span></p><p><span style="font-size: 14px;">2. 依据《商标条例》第 51 条提撤销：（1）无正当理由，商标注册后连续5年未在当地区实际使用；（2）成为通用名称或形状；（3）商标实际使用可能导致公众对商品/服务的性质、质量和产地产生误认。</span></p><p><br/></p><p><span style="font-size: 14px;">商标无效/撤销申请须向欧盟知识产权局提出，一般需耗时1年半到2年。被申请人一般可提供如下证据材料应对他人以“未使用”为由提出的撤销申请：</span></p><p><span style="font-size: 14px;">1. 发票；产品目录；营业额证据；</span></p><p><span style="font-size: 14px;">2. 包装、装潢；标签；报价单；</span></p><p><span style="font-size: 14px;">3. 广告；书面声明；市场调查结果</span></p>
